Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Operatorly platform at operatorly.co.uk (the "Platform"), operated by Operatorly Ltd ("Operatorly", "we", "us", "our"), a company registered in England and Wales. By registering or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. The Platform

Operatorly is an online marketplace that connects UK landlords with professional property operators. We provide a directory and registration service to facilitate introductions between landlords and operators. We are not a party to any agreement entered into between landlords and operators, and we do not provide property management, lettings, or financial services.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Platform. By registering, you confirm that the information you provide is accurate, current and complete.

The Platform is intended for use by UK-based landlords and property operators. Use from outside the UK is permitted but we make no representations that the Platform is appropriate or compliant with laws in other jurisdictions.

3. Registration and accounts

To access certain features of the Platform, you must register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Operator listings

Operators who register on the Platform may have their profile displayed publicly in our directory. By submitting a profile, you:

  • Confirm that all information provided is accurate and not misleading.
  • Grant Operatorly a non-exclusive licence to display your profile content on the Platform.
  • Agree to keep your profile information up to date.

We reserve the right to remove or edit any listing that we believe is inaccurate, misleading, or in breach of these Terms.

5. Landlord registration

Landlords who register on the Platform provide information about their portfolio to facilitate matching with suitable operators. By registering, you confirm that you are the owner or authorised representative of the properties described and that the information provided is accurate.

6. Early access and pricing

The Platform is currently in early access. During this period, registration and use of the Platform is free of charge for both landlords and operators. We reserve the right to introduce paid features or subscription tiers in the future. We will provide reasonable notice to registered users before any charges are introduced.

7. Prohibited conduct

You agree not to:

  • Provide false, misleading or fraudulent information on the Platform.
  • Use the Platform to harass, abuse or harm other users.
  • Scrape, copy or reproduce Platform content without our written permission.
  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Post or transmit any content that is defamatory, obscene, or infringes the rights of any third party.

8. Disclaimer of warranties

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not verify the accuracy of all operator or landlord information submitted by users and make no representations about the suitability of any operator or property for any particular purpose.

Any reliance you place on information found through the Platform is at your own risk. You are responsible for conducting your own due diligence before entering into any agreement with another user.

9. Limitation of liability

To the fullest extent permitted by law, Operatorly shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Platform, including but not limited to loss of profits, loss of data, or loss of goodwill.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim (or £100 if no payment has been made).

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Intellectual property

All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to Operatorly and is protected by UK and international intellectual property laws. You may not reproduce, distribute or create derivative works from Platform content without our prior written consent.

You retain ownership of content you submit to the Platform, but grant us a licence to use, display and distribute it as necessary to operate the Platform.

11. Third-party links

The Platform may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

12. Changes to these Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

13. Termination

You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your access to the Platform at any time if we believe you have breached these Terms or for any other reason at our discretion, with or without notice.

14. Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
